Special Qualified Personal Data Clarification Text

  1. Data Controller

In accordance with the Personal Data Protection Law No. 6698 ("KVKK"), your personal data may be processed by the data controller, the Foundation for Unhindered Education("Enev  or Foundation"), within the scope described below.    Within the framework of the article, it has been prepared with the aim of enlightening you about your personal data to be processed.

  1. Purposes for processing of SpecialLy Qualified Personal Data

Personal data of individuals related to race, ethnicity, political opinion, philosophical belief, religion, sect,  or other beliefs, disguises and clothing, association, foundation or union membership, health, sex life, criminal conviction, and security measures, and  biometric  and genetic data are of special quality personal data.

Your health data from special personal data are processed by the Foundation with your explicit consent in accordance with the conditions of Article 6 of the KVKK in order to plan, carry out and help you to benefit from health services within the scope of the program if you benefit from the Foundation's dormitories, housing, care and assistance services.

  1. Method of Collection of Personal Data and Legal Reason

In accordance with article 6/2 of the KVKK, personal data of special quality cannot be processed without the express consent of the data owner as a rule. However, personal data related to health and sexual life can only be processed by persons or authorized institutions and organizations under the obligation to keep secrets for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and financing, without seeking the explicit consent of the relevant person.

Your personal data of special quality can be collected by means of written/oral communication, e-mail, fax, telephone, mail, courier, hand delivery, especially the forms in electronic environment and the documents you will add to these forms.

  1. Transfer of Personal Data of Special Quality

You will be using your personal data of special quality in the 8th and 9th grades of the KVKK.  In accordance with the conditions in the articles, hospitals, family medicines, health institutions, pharmacies, Istanbul Governorship, Provincial Directorate of Family Work and Social Services, Provincial Health Directorate, Cemeteries Directorate and all other relevant legally authorized public institutions and organizations within the scope of the above-mentioned processing purpose can be transferred by the Foundation.

  1. Rights of Personal Data Owners

Section 11 of the Personal Data Protection Act. Data subjects in accordance with article;

  1. a) To find out if personal data has been processed,
  2. b) Requesting information about personal data if it has been processed,
  3. c) To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
  4. d) To know the third parties to whom personal data are transferred at home or abroad,
  5. e) Request correction of personal data if it is incomplete or inaccurately processed,
  6. f) Section 7 of the Law. Request the deletion or destruction of personal data within the framework of the conditions stipulated in the article,
  7. g) Request notification of transactions made in accordance with paragraphs (e) and (f) to third parties to whom personal data are transferred,
  8. h) Objecting to the emergence of a result against the person himself by analyzing the processed data exclusively through automated systems,
  9. i) Requesting compensation of damages in case of damages due to unlawful processing of personal data,


As personal data subjects, you submit your requests regarding your rights listed above in accordance with article 13 of the KVKK.  You can forward it to the Foundation in accordance with the article. Your requests will be finalized free of charge as soon as possible and within 30 days at the latest. However, if a fee tariff is stipulated by the Personal Data Protection Board, the Fee in that tariff will be charged by the Foundation.
